WayBetter is strongly committed to protecting the privacy of your personal information and to providing a safe and secure environment for our players. This Privacy Policy describes the information we collect when you visit our sites or use our services, and how we use, share, and protect that information.

By registering for, accessing, using, or visiting any of WayBetter’s games, services, apps, or sites — including without limitation www.waybetter.app, its websites and any mobile versions, and any software system designed to support or permit interaction with the website (collectively, the “Site”) — you (the “User”) signify that you have read, understand, and agree to be bound by this Privacy Policy, which is an integral part of our Terms of Use.

What This Policy Covers

This Privacy Policy covers WayBetter’s treatment of personal information that WayBetter collects when you use WayBetter’s websites, games, apps, and services. It does not apply to the practices of third parties that WayBetter does not own or control, or to individuals WayBetter does not employ or manage. Where this Policy refers to information collected or used by a Sponsor, partner, or other third party, that third party’s own privacy policy governs its handling of your information.

WayBetter’s Status Under Health Privacy Laws

WayBetter is a consumer wellness and gaming platform. We are not a healthcare provider, health plan, healthcare clearinghouse, or business associate of any of the foregoing, and we are not subject to the Health Insurance Portability and Accountability Act (“HIPAA”).

However, some information we collect — including information you provide about your weight, your participation in games tied to specific health conditions (such as games for users taking GLP-1 medications), and similar signals derived from your use of our services — may constitute “consumer health data” or “sensitive personal information” under applicable laws. See the Consumer Health Data Privacy Notice below.

Information We Collect

Information You Provide to Us

We receive and store information you enter on our website, submit through our games and apps, or otherwise provide to us. You can choose not to submit certain information, but you may then be unable to take advantage of some features.

Registration. To use WayBetter’s services you must create an account. Registration requires certain personal information (including name and email address).

User and Player Profiles. You may add additional information to your User Profile, including a profile photo. You may opt out of profile features by not providing this additional information.

Payment Information. WayBetter uses PCI-compliant payment processors and does not itself see or store your credit card details.

Invite Friends. If you choose to identify a friend, colleague, cheerleader, accountability partner, teammate, or similar third party through our invite, accountability-partner, team-game, or other social features, we may collect that recipient’s contact information so we can send invitations, messages, and reminders, and so we can track the success of our invitation programs. Recipients may contact support@waybetter.app to request that we remove this information.

Game and Other Submissions. To play WayBetter games, you may submit information, data, photos, videos, or other content during the course of the game, some of which may relate to health behaviors or status. We use this content to track player progress, determine winners, administer our games, prevent cheating and fraud, and — in aggregated or de-identified form — for research and product development.

Location Information. Information about your location may be collected in connection with certain games. You may opt out of such collection, except where it is integral to a game in which you choose to participate.

Automatic Information. We receive and store certain information whenever you interact with us, including information transmitted automatically about weight, steps, and other activities necessary for our games. We and our authorized agents also automatically receive and record server-log information from your browser, including IP address, cookie information, queries, and the page requested.

Additional Information. With your express consent, we may access your phone book and other tools on your devices to enhance your game experience.

Information Third Parties Provide to Us

Third-party suppliers (for example, Fitbit, Garmin, Apple Health, Google Fit, Runkeeper) may provide information to WayBetter in connection with our games. To the extent this information is not under WayBetter’s control, it is also subject to those suppliers’ privacy policies. It is your responsibility to review and accept those policies, recognizing that the use of such information may be essential to game participation.

How We Use the Information We Collect

WayBetter uses the information it collects to:

• contact you about your involvement or potential involvement in a game;

• bill users who have agreed to play or purchase products through our site;

• operate our games, including determining winners and awarding prizes;

• fulfill product orders;

• communicate with you about WayBetter news, features, products, surveys, promotions, updates, and case studies;

• facilitate social networking and game setup;

• for Sponsored Games, share your name, email address, and game outcome with the named Sponsor(s) as described in “Sponsored Games” below, conditioned on the consent you provide at signup;

• conduct research, analysis, and product development, generally using aggregated or de-identified data; and

• operate and improve our services in ways consistent with this Policy.

Sponsored Games

Some WayBetter games are sponsored by third-party businesses (each, a “Sponsor”). Sponsors may include companies offering products or services that are relevant to the game’s subject matter — for example, meal delivery services, fitness products, wellness brands, and other health-adjacent businesses.

Disclosure of Sponsor

Sponsored Games are clearly identified as sponsored before you sign up. The Sponsor (or Sponsors) will be named on the game’s entry screen and on the consent screen described below.

Sponsor sharing is a condition of entry

Because Sponsored Games are funded or supported by Sponsors and may include Sponsor-provided prizes, offers, or benefits, entry into a Sponsored Game requires your affirmative consent for WayBetter to share your name, email address, and game outcome with the named Sponsor(s). At signup, we will present a separate consent screen that:

• identifies the Sponsor(s) by name;

• states that WayBetter will share your name, email address, and game outcome with the Sponsor(s);

• explains how the Sponsor(s) may use that information, including for prize fulfillment, game-related offers, and ongoing marketing;

• explains what WayBetter will not share with the Sponsor(s) absent your separate, specific opt-in; and

• requires you to take an affirmative action (such as checking an un-prechecked box) to enter the Sponsored Game.

If you do not want WayBetter to share your name, email address, and game outcome with the Sponsor(s) as described, please do not enter that Sponsored Game. Other WayBetter games may be available that do not have a Sponsor.

What we share with Sponsors

For Sponsored Games, the information WayBetter shares with Sponsors is limited to:

• Your name;

• Your email address; and

• Whether you won, completed, or did not complete the Sponsored Game (your “game outcome”). This is the minimum information the Sponsor needs to fulfill the prize structure tied to your performance in the game.

We may share this information with the Sponsor at the start of the game (so that the Sponsor can communicate with all players, including with game-related offers or content) and/or at the conclusion of the game (so that the Sponsor can fulfill prizes, discounts, or other offers extended to participating or winning players).

What we do NOT share with Sponsors

WayBetter does not share individual-level Consumer Health Data with Sponsors as part of Sponsored Game consent. This means we do not share with the Sponsor any of the following about you as an individual, unless you provide separate, specific opt-in consent to do so:

• your weight, body measurements, or weight-loss results;

• your medication name, dosage, frequency, or method of administration (for example, injection vs. pill);

• your adherence data or other medication-related signals;

• your photos or videos submitted during the game;

• your specific medical conditions; or

• inferences derived from any of the above.

We may share with Sponsors aggregated and de-identified information about a Sponsored Game’s player base as a whole — for example, the total number of participants or aggregated information about the group — provided that such information cannot reasonably be linked back to you. See “Research, Analytics, and Aggregated Data” below.

How Sponsors may use the information

Sponsors may use the name and email you have authorized WayBetter to share to:

• contact you for prize fulfillment and to provide game-related offers; and

• send you ongoing marketing communications about the Sponsor’s products and services, until you unsubscribe.

Once your name and email are shared with a Sponsor, the Sponsor’s own privacy policy governs the Sponsor’s further use of that information. You can unsubscribe from a Sponsor’s communications using the Sponsor’s unsubscribe mechanism (typically a link in each marketing email) or by contacting the Sponsor directly.

Revocation

You may revoke your consent to WayBetter’s sharing of your information with a Sponsor at any time by contacting support@waybetter.app. Revocation will stop further sharing of your information with the Sponsor by WayBetter where operationally possible. However, revocation cannot undo information that has already been shared with the Sponsor. To request that the Sponsor delete or stop using information already shared, you must contact the Sponsor directly; WayBetter will cooperate with such requests to the extent legally required.

Consumer Health Data Privacy Notice

This section serves as WayBetter’s consumer health data privacy notice under the Washington My Health My Data Act, Nevada SB 370, and similar laws.

Some of the information you provide to us — including information you provide in connection with games involving weight, weight management, medication use, or other health-related behaviors — may constitute “consumer health data” under applicable law. This section describes how we collect, use, share, and protect that information.

Categories of consumer health data we may collect

• Body measurements and biometric signals, including weight, BMI, and step counts;

• Information about your participation in health-related games (for example, that you are participating in a game for users of GLP-1 medications);

• Information you voluntarily provide during quizzes, surveys, or game flows, which may include information about your health conditions, medications, or treatment journey;

• Photos, videos, and other submissions you provide during the course of a game; and

• Inferences derived from any of the above.

How we use consumer health data

We use consumer health data to:

• operate our games (including determining eligibility, tracking progress, and awarding prizes);

• personalize your experience and communicate with you about your account;

• detect fraud and abuse; and

• improve our products and services.

How we do and do not share consumer health data

We do not share individual-level consumer health data with Sponsors, advertisers, or other third parties for their own marketing purposes except where you provide separate, specific opt-in consent. The consent you provide at signup for a Sponsored Game does not authorize sharing of individual-level consumer health data.

We may share consumer health data:

• with service providers who help us operate our services, under contractual obligations to protect the data and use it only for our purposes;

• in aggregated or de-identified form, with research partners, analytics providers, Sponsors, and others, in ways that cannot reasonably be linked back to you (see “Research, Analytics, and Aggregated Data”);

• where required by law or to protect rights and safety; and

• in connection with a business transfer, subject to the protections described in this Policy.

Your rights with respect to consumer health data

Subject to applicable law, you may:

• confirm whether we are collecting, sharing, or selling your consumer health data, and access that data;

• withdraw any consent you have given to our collection or sharing of your consumer health data;

• request deletion of your consumer health data; and

• appeal our response to any of the foregoing requests.

To exercise these rights, contact support@waybetter.app with the subject line “Consumer Health Data Request.” We will respond within the timeframes required by applicable law.

Information Shared in Games and Communication Channels

If you participate in a WayBetter game or use a bulletin board, blog, chatroom, or other WayBetter communication channel, information you submit there can be read, collected, or used by other users and may be further disseminated outside of WayBetter. While we aim to maintain privacy within games and communication channels, we cannot guarantee that information shared there will remain private. Do not provide any information you consider highly confidential or that you would not want further disseminated.

We may also connect to certain third-party services. Any information you choose to share through those connections may be sent to those third-party services based on your account settings and authorizations.

Email and Other Communications

We send welcome emails after you register, and we send emails to respond to your inquiries, manage your account, and facilitate the activities described in this Policy. Unless you opt out, we also send motivational newsletters and game-related messages.

If you do not want to receive marketing email from us, follow the unsubscribe link in any marketing email, or email support@waybetter.app from the address you want to remove. To opt out of push notifications, change your settings in the app menu. You will continue to receive certain system emails (such as those concerning your password or active games) and legal notices (such as updates to this Policy).

If you have entered a Sponsored Game, you may also receive communications from the Sponsor; those communications are governed by the Sponsor’s privacy policy and unsubscribe practices.

Cookies, Pixels, SDKs, and Similar Technologies

We use cookies, pixels, mobile SDKs, server-side event tools, and similar technologies (collectively, “Tracking Technologies”) on our websites and in our apps. We use them to recognize registered users, store session-specific information, facilitate login, analyze use of our services, measure the effectiveness of communications, and detect fraud.

We take care to limit the categories of information transmitted through Tracking Technologies. In particular, we work to ensure that Tracking Technologies operating on pages or screens associated with health-related games do not transmit individual-level consumer health data to advertising platforms or third-party analytics providers in a manner inconsistent with this Policy.

Most browsers let you refuse cookies or notify you when cookies are set. You may reject our cookies and still navigate parts of our site, but you must have cookies enabled to participate in a game. Some of our vendors, affiliates, and business partners may also use Tracking Technologies. We have no access to or control over those Tracking Technologies, and their use is not covered by this Privacy Policy except as described in “Your Privacy Choices” below.

Sharing Your Information

WayBetter shares non-personal and aggregated information — such as aggregate user statistics, demographic information, and app and website usage information — with third parties in the ordinary course. We share personally identifiable information only as described below.

WayBetter Personnel and Affiliates. WayBetter personnel, approved academic researchers, authorized consultants and contractors, and payment processors may have access to user information if necessary in the normal course of WayBetter’s business and research.

Service Providers. We employ third parties to perform functions on our behalf — for example, hosting and operating our websites and apps, fulfilling orders, sending communications, providing marketing assistance, processing payments, and providing customer service. These third parties have access to personal information only as necessary to perform those functions and are bound by contractual obligations to use it only for those purposes.

Sponsors. As described in “Sponsored Games” above, when you enter a Sponsored Game and provide the required consent, we share your name, email address, and game outcome (whether you won, completed, or did not complete the game) with the named Sponsor(s). We do not share individual-level consumer health data with Sponsors except with separate, specific opt-in.

Business Transfers. If WayBetter or substantially all of its assets are acquired, or in connection with a merger, financing, reorganization, bankruptcy, or sale of assets, user information may be one of the assets transferred. Any such transfer will be made on the condition that the recipient uses standards of privacy substantially similar to those described in this Policy.

Legal and Safety. We may disclose personal information when we believe in good faith that disclosure is necessary to comply with law; to enforce our Terms of Use; to respond to a court order, judicial proceeding, subpoena, or other legal process; to investigate or prevent fraud, security incidents, or abuse; or to protect the rights, property, or safety of WayBetter, our users, or others.

Information You Choose to Make Public. Information you voluntarily make public on the Site (for example, a public profile, public game post, or public comment) may be accessed and used by third parties. WayBetter keeps passwords and other account credentials private at all times. With Your Consent. Except as described in this Policy, we will not share your personally identifiable information with third parties for purposes incompatible with the purposes for which it was collected without your prior permission.

Research, Analytics, and Aggregated Data

WayBetter uses information collected through games, quizzes, and other interactions for internal research and analytics aimed at improving our products, services, and user experience. We perform this analysis using aggregated or de-identified data, except where we have your consent to use individual-level data.

Sharing of aggregated and de-identified data. We may share, sell, license, or otherwise make available aggregated and de-identified datasets and audience-level insights with research partners, business partners (including Sponsors), and academics to advance game design, behavioral research, public-health research, and related fields.

De-identification practices. We use reasonable technical and organizational measures designed to prevent aggregated or de-identified data from being linked to an identifiable individual, and we do not attempt to re-identify such data except as permitted by law. We do not include personally identifiable information or individual-level consumer health data in datasets shared with Sponsors or other third parties without your separate, specific opt-in.

Use to train artificial intelligence systems. We may use anonymized and aggregated user submissions to train artificial intelligence systems, including our own and those of service providers acting on our behalf. We will not include personally identifiable information in any data used to train third-party AI systems without your separate opt-in consent.

Personalized Services

Information you share with us allows us to personalize and customize your experience. This includes personalized game suggestions, customized pricing, personalized tips and recommendations, and other tailored offerings designed to meet your interests. Where personalization uses consumer health data, we will do so consistent with the Consumer Health Data Privacy Notice above.

Healthcare and Health-Related Partner Engagement

From time to time, WayBetter may partner with healthcare providers, telehealth companies, pharmacies, insurers, or similar health-related businesses (each, a “Health Partner”) whose services may be relevant to our users. If a Health Partner sponsors a game, that game is a Sponsored Game and the rules above apply. If a Health Partner does not sponsor a game but you have provided your specific opt-in consent to be contacted by that Health Partner, we may share your contact information with the Health Partner so that the Health Partner may contact you to offer services or information.

Structural separation. WayBetter is not a healthcare provider and is not a business associate of any Health Partner. When we share your information with a Health Partner under this section, we do so as a marketing referral; we do not transmit clinical or treatment data to the Health Partner, and we do not collect clinical or treatment data from the Health Partner on its behalf. Any clinical relationship you form with a Health Partner is governed by that Health Partner’s own privacy policy, terms, and notice of privacy practices, which the Health Partner will provide to you directly.

Your Privacy Choices

You have a number of choices about your information.

Account information

By visiting your User Profile, you can correct, amend, add, or delete personally identifiable information. When you update information, we may maintain a copy of the prior information as part of our back-up procedures and to comply with legal requirements.

Marketing communications from WayBetter

You can unsubscribe from WayBetter marketing emails using the unsubscribe link in any such email, or by emailing support@waybetter.app. You will continue to receive system emails (such as those concerning your password or active games) and legal notices.

Sponsor communications

Communications from Sponsors are governed by the Sponsor’s privacy practices. You can unsubscribe from Sponsor marketing using the Sponsor’s unsubscribe mechanism or by contacting the Sponsor directly. You can also revoke WayBetter’s authorization to share further information with a Sponsor by contacting support@waybetter.app, as described in “Sponsored Games.”

Do Not Sell or Share My Personal Information

WayBetter does not sell personal information for monetary consideration in the traditional sense. However, applicable state laws (including the California Consumer Privacy Act, as amended) define “sale,” “sharing,” and “targeted advertising” broadly. The sharing of name and email with Sponsors of Sponsored Games, and certain uses of Tracking Technologies, may be treated as a “sale,” “sharing,” or related activity under one or more of those laws.

You may opt out of such activity by:

• using the “Do Not Sell or Share My Personal Information” link on our website or in our app where required by applicable law;

• using a recognized opt-out preference signal such as Global Privacy Control where required by applicable law;

• revoking your Sponsor sharing consent by emailing support@waybetter.app (note: revocation prevents future sharing but does not undo prior sharing); and

• declining to enter Sponsored Games.

Global Privacy Control and opt-out preference signals

Where required by applicable law, WayBetter honors Global Privacy Control (“GPC”) and other recognized opt-out preference signals as requests to opt out of sale, sharing, targeted advertising, or similar activities, as those terms are defined under applicable law, with respect to the browser or device transmitting the signal. Because GPC is browser- and device-specific, your opt-out may not extend to other browsers, devices, or to information previously shared with Sponsors based on prior consent.

California Notice of Financial Incentive (contingent)

This subsection applies only if and to the extent that the value provided by WayBetter or a Sponsor in connection with a Sponsored Game is determined to constitute a “financial incentive” under the California Consumer Privacy Act. Sponsor sharing is a condition of entry into a Sponsored Game, and the information below describes the material terms of that arrangement should it be so characterized.

To the extent Sponsored Game benefits constitute a financial incentive under the CCPA, the material terms are: (a) you provide your name, email address, and Sponsored Game outcome to WayBetter for sharing with the named Sponsor(s); (b) WayBetter and the Sponsor(s) use that information to provide the Sponsored Game, Sponsor-funded prizes, game-related offers, and Sponsor marketing; (c) we estimate the value of the personal information based on the value of Sponsor funding, prizes, discounts, or other benefits made available in connection with the Sponsored Game, together with the costs of providing the Sponsored Game experience; and (d) you may withdraw from the financial incentive by revoking your consent to further Sponsor sharing or unsubscribing from Sponsor communications, though revocation does not undo information already shared with a Sponsor.

Account deletion

You may request deletion of your WayBetter account by emailing support@waybetter.app. We will respond to verifiable requests within the timeframes required by applicable law and, in any event, within 45 days.

Minors

Minors under age 18 are prohibited from registering for or using our services. We do not knowingly collect or solicit information from anyone under 18, and we will delete that information promptly if we learn we have collected it. If you believe we may have information from or about a minor under 18, please contact us.

Keeping Information Secure

The security of your information is extremely important to us. Your WayBetter account information is protected by a password. We follow generally accepted industry standards to protect personal information, including encryption in transit, access controls, firewalls, and hashing of select categories of information. When you enter sensitive information (such as credit card numbers), we use transport-layer encryption.

No method of transmission or electronic storage is fully secure, however, and WayBetter cannot guarantee absolute security. Only employees who need access to personal information to perform their jobs are granted that access, and our personnel are trained on our privacy and security practices.

Supplemental Privacy Provisions for California Residents

This section supplements the rest of this Policy and applies solely to California residents under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, “CCPA”).

Categories of personal information

In the preceding 12 months, we have collected the categories of personal information described in “Information We Collect” above, including identifiers (such as name and email), commercial information, internet activity information, geolocation information, sensory information (such as photos submitted during games), inferences, and — to the extent it qualifies — sensitive personal information (including health-related information you submit in connection with games). We use and share this information as described in “How We Use the Information We Collect” and “Sharing Your Information.”

Sale, sharing, and targeted advertising

WayBetter does not sell personal information for monetary consideration in the traditional sense. We acknowledge, however, that the CCPA defines “sale,” “sharing,” and “targeted advertising” broadly. In particular:

• With your consent, we share name and email with Sponsors of Sponsored Games, who may use that information for marketing. To the extent this is treated as a “sale” or “sharing,” you may opt out as described in “Your Privacy Choices.”

• Our use of Tracking Technologies may, depending on configuration, be treated as “sharing for cross-context behavioral advertising.” You may opt out using the methods described in “Your Privacy Choices.”

Sensitive personal information

We do not use or disclose sensitive personal information for purposes other than those permitted by the CCPA without offering you the right to limit such use. You may direct us to limit the use of sensitive personal information to specified purposes by contacting support@waybetter.app.

Your rights

Subject to verification, California residents may:

• request to know what personal information we have collected, used, and shared in the preceding 12 months;

• request access to and a copy of that personal information;

• request correction of inaccurate personal information;

• request deletion of personal information;

• opt out of any sale or sharing of personal information; and

• direct us to limit the use of sensitive personal information.

To exercise these rights, submit a verifiable consumer request to support@waybetter.app with the subject line “California Privacy Rights Request.” We verify requests using the information associated with your account; government identification may be required in some cases. We will not discriminate against you for exercising your CCPA rights, except as permitted by law in connection with any financial incentive described in “Your Privacy Choices.”

State Privacy Rights — Other States

If you are a resident of Colorado, Connecticut, Texas, Oregon, Virginia, Utah, or another U.S. state with a comprehensive privacy law, you may have rights with respect to your personal information — which may include the right to access, correct, delete, or port your personal information; to opt out of certain processing (including processing of sensitive personal data, sale, targeted advertising, and certain profiling); and to appeal our response to your request. Where required by applicable law, we honor recognized opt-out preference signals (such as Global Privacy Control).

To exercise these rights, contact support@waybetter.app and identify the state under which you are submitting your request. We will respond within the timeframes required by applicable law.

European Union, United Kingdom, and EEA Users

WayBetter’s services are primarily directed to users in the United States. Where we knowingly collect personal data from users in the European Union, the United Kingdom, or the European Economic Area, we process that personal data consistent with the General Data Protection Regulation (“GDPR”) and the UK GDPR.

Legal bases for processing

We process personal data on the following legal bases:

• performance of a contract (when you sign up to play a game or use our services);

• your consent (for example, when you opt in to Sponsored Game sharing or to consumer health data processing for marketing purposes);

• our legitimate interests, where those are not overridden by your rights (for example, operating and improving our services and preventing fraud); and

• compliance with legal obligations.

Your rights

Subject to applicable law, you have the right to access, rectify, erase, restrict, and port your personal data; to object to processing based on legitimate interests; and to withdraw any consent you have given. You also have the right to lodge a complaint with a supervisory authority. To exercise these rights, contact support@waybetter.app.

International data transfers

Personal data collected from users in the EU, UK, or EEA may be transferred to and processed in the United States. Where required, we rely on Standard Contractual Clauses or other lawful transfer mechanisms.

Changes to This Privacy Policy

WayBetter may amend this Privacy Policy from time to time. If we make material changes, we will notify you by updating the “Last updated” date at the top of this Policy and, where appropriate, by other means (for example, a notice on our website or in our app). For changes that materially expand the categories of information shared with third parties, or that materially change how we handle consumer health data, we will seek your renewed opt-in consent where required by law. Your continued use of our services after a change takes effect constitutes acceptance of the updated Policy.
